Xanado Trade or Invest 141 (Pty) Ltd proposes to develop a residential township on the Farm Zandkop Zyn Laagte 108-JR, to be known as, Refentse Extension 9. The proposed residential township development and associated services, requires an environmental authorisation from the Gauteng Department of Agriculture and Rural Development (GDARD), as it is a listed activity in terms of Listing Notices1 (GN R.983), Listing Notice 2( GN R.984) and Listing Notice 3 (GN R.985) of the EIA Regulations, 2014 (as amended). as independent environmental assessment practitioners, were appointed by Xanado Trade or Invest 141 (Pty) Ltd, to apply on their behalf, for the environmental authorisation as regulated in the EIA Regulations, 2014 (as amended).

PURPOSE OF DOCUMENT
Public participation is an important aspect of the environmental authorisation process, and provides Interested and Affected Parties (I&AP’s) with the opportunity to contribute in the environmental decision making process from the planning phases of the proposed development. The input received from I&APs facilitates informed decision-making by the competent authority, Gauteng Department of Agriculture and Rural Development (GDARD), resulting in better decisions, as the views of all parties are considered.
The purpose of this Background Information Document (BID) is to provide the surrounding landowners or community and public in general, information about the proposed development, and how those wishing to be registered as I&APs can effectively participate in the environmental assessment and decision-making process. This BID further provides you with the following information:
• An overview of the environmental legislative context and a description of the environmental application process being followed;
• Details on how you can get involved in the Public Participation Process; and
• Contact details of the Environmental Assessment Practitioner (EAP) whom I&APs should contact regarding their issues and concerns associated with the proposed project.
Environmental Authorisation Process
As required under Section 24 of the National Environmental Management Act, 1998 (Act No.107 of 1998) (NEMA), as amended, the proposed residential development and associated services are listed activities requiring environmental authorisation in terms of the EIA Regulations, 2014 (as amended) (refer to Section 5 below). The identified application process for environmental authorisation is a Scoping and Environmental Impact Assessment (EIA) process, as provided in Regulation 15(2)(b) of the EIA Regulations, 2014 (as amended).
The Environmental Impact Assessment (EIA) process to be followed including the objective, scope, and content of the report, is in terms of Regulation 21-24 and Appendix 2 of the EIA Regulations, 2014 (as amended). The BA Report will include an Environmental Management Programme compiled as set out in Appendix 4 of the EIA Regulations, 2014 (as amended).
All registered I&APs will be given the opportunity to review all the Scoping and EIA reports and to submit their written comments (if any) within the regulated timeframe of 30 days from the date the report is made available for public review.
PUBLIC PARTICIPATION PROCESS
The public participation process to be followed, as part of the Scoping & EIA process, comprises of the following steps in different phases, as indicated in the flow chart below
Pre-Application Phase:
• Invite the public and surrounding community to register as an Interested and or Affected Party through: circulation of the BID; erection of Site Notices; and publication of the notice in a local and provincial Newspaper.
• Open a register of Interested & Affected Party(s).
• Any comments received following the 30 days registration process to be taken into consideration and incorporated into the Draft Scoping Report (DSR).
SCOPING PHASE
• Provide registered I&APs and stakeholders the opportunity to review and comment on the DSR (30 days) .
• Comments received to be responded to, and taken into consideration in the Final Scoping Report (FSR).
• Submit FSR & EIA Plan of Study to the Competent Authority (CA) for approval, and simultaneously provide registered I&APs and stakeholders the opportunity to comment within 30 days.
• Proceed to the EIA Phase upon approval of the FSR & EIA plan of study by the CA.
EIA PHASE
• Provide registered I&APs and stakeholders the opportunity to review and comment on the draft EIA Report & Environmental Management Programme (EMPr) within 30 days.
• Comments received to be responded to, and taken into consideration in the Final EIA Report & EMPr.
• Submit Final EIA Report & EMPr to the CA for review and decision making, and simultaneously provide registered I&APs and stakeholders the opportunity to review and comment within 30 days.
• The CA has 107 days to make a decision on the application upon receipt of all the required information.
NOTIFICATION OF DECISION
• Notify all registered I&APs and stakeholders of the CA’s decision and their right to appeal against the decision if they wish so within 14 days from the date of the notice.
• Notice to include the appeal process to be followed as contemplated in the National Appeal Regulations, 2014 (as amended).
I&AP’s can become involved by:
• Registering with ILA either by telephone, fax or email as per the contact details provided above;
• Responding to our invitation for your involvement as advertised in the weekly edition of the Hammanskraal News on ..…, & the daily edition of the Pretoria News on……….; and
• Sending us your comment on this BID or any of the EIA documents which will be made available for public review in due course.
The Ward Councillor of the area has been notified about the proposed development and the Public Participation Process being followed as part of the EIA process. Site notices inviting the public to register as I&APs were displayed at locations visible to the surrounding community and along the main public roads leading to the development site.
