الموضوع: إنذار مطالبة وتكليف المنذر اليهم بالوفاء بمبلغ وقدره درهم ( مليون درهم لا غير)، مع الفوائد الاتفاقية المستحقة على هذا المبلغ اعتباراً من تاريخ الاستحقاق وحتى تمام السداد
الموضوع:
1. بتاريخ 17 يونيو 2015، تم ابرام اتفاقية التسهيلات بالمرجعية رقم MM DUB 156441 بين المنذر والمنذر اليها الأولى
2. تم تقديم كفالات تضامنية من المنذر اليهم الثانية والثالثة والرابعة والخامسة لضمان سداد مبلغ التسهيلات المستحق بموجب اتفاقية التسهيلات المبرمة مع المنذر اليها الأولى.
3. وبتاريخ 18 يوليو 2017 تم تعديل اتفاقية التسهيلات بموجب اتفاقية تعديل التسهيلات برقم مرجعية MM DUB 175298 ليصبح مبلغ التسهيلات الممنوح للمنذر اليها الأولى مبلغ وقدره 8,000,000 درهم (ثمانية ملايين درهم ).
4. لم تسدد المنذر اليها المبالغ المستحقة للمنذر بموجب اتفاقية تعديل التسهيلات المشار اليها فترصد في ذمتها مبلغ درهم
5. وحيث ان المنذر اليهم الثانية والثالثة والرابعة والخامسة هم الكفلاء الضامنين للدين المترصد في ذمة المنذر اليها الأولى بموجب اتفاقية تعديل التسهيلات المشار اليها فانهم يكونون ملزمون بالتضامن معها بسداد مبلغ الدين للبنك المنذر
بناء عليه
يوجه البنك المنذر هذا الإنذار الى المنذر اليهم ليطالبهم بسداد مبلغ وفوائده المتفق عليها في اتفاقية تعديل التسهيلات والا سيتخذ كافة الإجراءات القانونية ضدهم للمطالبة بالمبالغ المترصدة في ذمتهما لصالحه بما في ذلك رفع الدعاوى القضائية امام المحاكم المختصة .
يحتفظ المنذر بجميع الحقوق فيما يتعلق باتفاقية التسهيلات والكفالة التضامنية محل هذا الإنذار بما في ذلك ودون الحصر الحجز على أي أصول مرهونة أو حوالة حق ممنوحة إلى المُنذر أو التنفيذ على أي ضمانات أخرى يكون قد منحها المنذر إليهما أو أي طرف ثالث إلى المنذر أو مباشرة الإجراءات القانونية لاستراد المديونية المستحقة بالإضافة للفوائد.
لا تخل هذه المطالبة بأي من الحقوق الأخرى العائدة للمنذر، ولا تعتبر تنازلا من المنذر عن أي من حقوقه الأخرى أو الاجراءات الإضافية الممنوحة له بموجب القانون.

Translation - English Legal Notice via Notary Public
Subject: Notice of demand and request of payment on the Notified Parties to pay an amount of AED ... (... million UAE dirhams only), plus the payable contractual interest on such amount as from the due date until full payment.
Subject:
1. On 17 June 2015, a facility agreement (Ref. No. MM DUB 156441) was entered into between the Notifying Party and the First Notified Party.
2. Joint guarantees were furnished by the Second, Third, Fourth and Fifth Notified Parties to secure payment of the Facility Amount due under the Facility Agreement concluded with the First Notified Party.
3. On 18 July 2017, the Facility Agreement was amended by virtue of the Facility Amendment Agreement (Ref. No. MM DUB 175298), whereby the Facility Amount availed to the First Notified Party shall become AED 8,000,000 (Only eight million UAE dirhams).
4. The Notified Party failed to pay the amounts owed to the Notifying Party under the aforementioned Facility Amendment Agreement. As a consequence, the Notified Party owes the Notifying Party a sum of AED .
5. Whereas the Second, Third, Fourth, and Fifth Notified Parties are the guarantors of the debt owed by the First Notified Party under the aforementioned Facility Amendment Agreement, they and the First Notified Party shall jointly pay the amount of the debt to Notifying Bank.
THEREFORE,
The Notifying Bank serves this Notice on the Notified Parties, requesting the same to pay a sum of and such contractual interest as set out in the Facility Amendment Agreement; otherwise, the Notifying Bank will take all legal actions against the Notified Parties to demand payment of the amounts owed thereto by the Notified Parties. Such legal actions may include lawsuits to be filed before competent courts.
The Notifying Party hereby reserves all its rights with regard to the Facility Agreement and the joint guarantee, the subject matter of this Notice, including but not limited to, the levying of attachment on any pledged assets or any assignment of right granted to the Notifying Party, or the enforcement against any other guarantees that the Notified Parties or any third party may have granted to the Notifying Party, or the initiation of legal actions to recover the outstanding debt and the interest payable thereon.
This demand shall neither prejudice any of the other rights of the Notifying Party, nor shall it constitute a waiver by the Notifying Party of any of its other rights or additional actions vested under the law.
