Any other mistakes y'all see please feel free to point out. I've been translating "im Außenverhältnis" as "trading with third parties" here but don't know what to do in this case with eintreten...

Ist unter den Parteien streitig, welche Partei entstandene Kosten, Zahlungen oder Zahlungsausfälle zu tragen hat oder in welcher Höhe sie zu tragen sind so treten die Parteien im Außenverhältnis gemäß Punkt 3.1. ein, unbeschadet einer anderweitigen Aufteilung im Innenverhältnis.

If the parties cannot agree as to which party shall bear costs, payments or non-payments incurred or as to the ratio they are to be borne, then the parties shall eintreten im Außenverhältnis pursuant Paragraph 3.1, without prejudice to another type of distribution in the internal relationship

Here, "eintreten" means the parties are liable in relation to third parties in accordance with Paragraph 3.1.

Basically I agree with Eike here. If A and B have jointly incurred an expense (let's say, getting a broken window mended by C) but they can't agree how to divide the cost between themselves, then their payment to C is governed by 3.1, irrespective of how the cost is eventually divided up between them.

Note that this is eintreten IM Außenverhältnis - Jonathan's suggestion would need an accusative rather than a dative construction if it were to hold water.
