I am working on an academic paper on innovation. Part of the paper deals with patents, a subject I am not familiar with. In this particular section, the discussion centers on 生存特許 vs. 権利が消滅した特許 (patents for which patent rights have expired?). I assume that 生存特許 means roughly an active, or valid, patent, but am not sure, and also don't know how to best refer to this in English.
