If, on the contrary, under applicable national law, the rights and obligations of one of the original parties (the shipper or the carrier) have not been transferred to the third party, the competent national court before which the case was filed must verify, under the requirements listed in points (a), (b) and (c) of Article 23(1) of the new Lugano Convention, if the third party in fact consented to the jurisdiction clause invoked against them.

Si, au contraire, les droits et obligations d’une des parties d’origine (le chargeur ou le transporteur) n’ont pas, sous le droit national applicable, été transmis au tiers, le tribunal national compétent auprès duquel l’action en justice a été intentée doit vérifier, d’après les conditions énumérées aux points a), b) et c) de l’article 23, paragraphe 1, de la nouvelle convention de Lugano, si le tiers a bien consenti à la clause attributive de compétence invoquée contre lui.
