German term
mit anderen (Gegenansprüchen) als solchen, die unstreitig oder rechtskräftig festgestellt sind
German to English
Law/Patents
Law: Contract(s)
In fact it's the whole sentence that's stumped me. The phrase appears in the sentence, 'Der Lizenzpartner ist nicht berechtigt, gegenüber Ansprüchen der Lizenzgeberin mit anderen Gegenansprüchen als solchen, die unstreitig oder rechtskräftig festgestellt sind, ein Zurückbehaltungsrecht auszuüben'. This type of provision is quite common although in this case, the wording is a little strange and so I'm not sure if something else is meant. In respect of what is the licensee not entitled to exercise the right of retention? Or is it just my imagination?

As you say, it is a fairly standard condition, although a bit obscure in the way it is expressed.
The Lizenzpartner is not entitled to excercise a right of retention with counterclaims other than those that are undisputed or
..... with other counterclaims unless they are undisputed or ..
Dietl/Lorenz:
ein rechtskräftig festgestellter Anspruch - a claim which has become res judicata; claim recognized by declaratory judgment

Comment: "In fact, my problem was with the words '...als solchen...' meaning '(other) than those...'but anyway your answer cleared up the whole sentence for me. Thanks."
